Terms of use
About these terms
These terms are an agreement between you and Swell Technology Limited ("FishGauge", "we", "us"). They cover the FishGauge app and website. By creating an account or using FishGauge, you agree to them. Our privacy policy explains how we handle your personal information.
Your account
- You must be 13 or older to create an account. Younger anglers may use FishGauge with a parent's or guardian's permission.
- Give accurate details, keep your sign-in to yourself, and tell us if you think someone else has used your account.
- One account is for one person.
FishGauge is still being built
FishGauge is in its early release. Features will change, some may stop or move, and the service may sometimes be unavailable. Keep your own copy of anything that matters to you. You can download your catches as a spreadsheet file from Settings › Your account.
Measurements and weights are estimates
- FishGauge reads the length from the printed scale of the measuring mat in your photo. It can be wrong. Check the length before you save, and correct it if needed.
- A fish is measured correctly only if the photo is taken the way FishGauge asks: the fish's nose against the mat's stop, the fish flat and straight on the mat, and the printed scale clear past the tail.
- The weight shown is an estimate worked out from the species and the length. For most species it uses Fisheries New Zealand's published length-to-weight curves, and for kingfish the Export competition's calculator. It is never used for scoring.
- FishGauge does not check legal minimum sizes, daily limits, closed areas or any other fishing rule. Following the fishing rules for where and what you fish is your responsibility. The Ministry for Primary Industries publishes them.
Fish and fish safely
- Handle fish with care, and release them quickly when you are releasing them.
- Your safety on the water is your responsibility. Don't let the app distract you from it.
Your photos and catches
- Your photos and catch records remain yours.
- You give FishGauge permission to store, copy and process them, and to show them to you and to the people in the competitions you enter, as our privacy policy describes. You also give us permission to use them to check and improve how FishGauge measures fish and recognises species.
- Only upload photos you have the right to use. Don't upload anything unlawful or offensive, or photos of other people without their permission.
Competitions
Who runs a competition
- Club competitions are run by their organisers. The organiser sets the species, dates, entry requirements, rules and any prizes, and is responsible for them. FishGauge provides the tools.
- Mates comps are started by an angler for their friends. They have no judge: each angler's own length counts.
Terms of entry
When you enter a competition, you agree that:
- your name, as the board shows it, and the fish that count, with their species, length, catch time and photo, are shown to the competition's members, organisers and judges;
- in a club competition, the organisers can see your entry details (full name, address, phone and email);
- in a judged competition, a catch can be checked by the competition's approved judges, and their ruling stands under that competition's rules;
- the published results are the competition's historic record. Your name and your fish stay in them, even if you later delete your account.
Fair play
Don't change or fake a photo, a mat or a length, enter another person's fish, or enter one fish more than once. An organiser may remove an entrant, and FishGauge may suspend an account for cheating.
Using FishGauge properly
Don't:
- try to see other people's information, or get around FishGauge's security;
- copy or collect FishGauge's content or data by automated means;
- copy or reverse engineer the app, except as the law allows;
- disrupt the service, or send unwanted invitations;
- pretend to be someone else.
Paid features
FishGauge is free to use today. If we introduce paid features, we will show the price and its terms before you pay.
Your consumer rights and our liability
- Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that cannot be excluded.
- To the extent the law allows, FishGauge is not liable for:
- catches or data you lose;
- the outcome of any competition, or an organiser's or judge's decision;
- decisions you make based on an estimated length or weight;
- any loss of profit, or indirect or consequential loss.
Ending your use of FishGauge
- You can stop using FishGauge at any time, and delete your account in Settings › Your account. What happens to your information when you do is set out in our privacy policy.
- We may suspend or close an account that breaks these terms. We will tell you why, unless the law or safety prevents it.
Changes to these terms
We will tell you in the app before an important change takes effect. If you keep using FishGauge after the change, you accept the new terms.
New Zealand law
New Zealand law governs these terms, and the New Zealand courts can decide any dispute about them.
